NOTICE OF SUBSTITUTE TRUSTEE’S SALE

In execution of that certain Credit Line Deed of Trust dated November 8, 2023 and recorded on November 8, 2023 in the Circuit Court Clerk’s Office of Wise County, Virginia as Instrument Number 202304696, and by virtue of the authority vested in the undersigned Substitute Trustee, any one of whom may act, by said Credit Line Deed of Trust, and the Deed of Appointment of Substitute Trustee recorded in the Circuit Court Clerk’s Office of Wise County, Virginia as Instrument Number 202601868, default having been made in the terms of the Note secured by the Credit Line Deed of Trust, and having been requested to do so by the Holder of the Note, the undersigned Substitute Trustee will offer for sale at public auction the following property as described in said Deed of Trust:
All those certain tracts, pieces or parcels of land, situate, lying and being in Wise County, Virginia, and being more particularly described as follows, to-wit:
TRACT ONE:
BEGINNING at a stake at the intersection of the northern line of U.S. Alternate Highway 58 with the eastern line of the highway leading to Big Toms Creek; thence with the road leading up Big Toms Creek with a curve to the left, whose radius is 1125 feet and a distance of 188 feet to a stake at the intersection of the eastern line of said road with the southern line of a 20 foot alley; thence with the southern line of the said alley, S 07 W 172.0 feet to a stake at the intersection of the southern line of the said 20 foot alley, with the northern line of the said U.S. Highway Alt 58 leading to St. Paul, Virginia; thence with the northern line of said highway N 57 30 W 33.0 feet to a stake; thence with a curve to the left, whose radius is 265 feet, and a distance of 107.0 feet to the point of BEGINNING, and being known as Lot 34 of Banner, Wise County, Virginia, as shown on a map of “Banner,” dated October 30, 1946, Which said map is of record in the Wise County Circuit Court Clerk’s Office.
BEING the same property conveyed to the Assembly of God Church as Banner by Deed dated June 12, 2009, and recorded in the Wise County Circuit Court Clerk’s Office as Instrument Number 200902532.
TRACT TWO:
All that certain strip of parcel of land lying and being situate on the waters of Lick Branch of Little Tom’s Creek at and near Banner in Lipps Magisterial District of Wise County, Virginia, which is more particularly bounded and described as follows:
BEGINNING at an iron pin, the southeast corner of Banner Assembly of God Church parcel (Instrument 2009030183); thence with the said parcel N 29-53-22 E 196.30 feet to an iron pin; thence continuing with the said parcel N 48-06-38 W 119.41 feet to an iron pin; thence S 28-29-20 W 53.17 feet to an iron pin; thence N 70-40-40 W 78.35 feet to an iron pin in the eastern right of way line of Virginia State Route 653; thence following the eastern right of way of Virginia State Route 653 along a circular curve to the left (Length 37.10, radius 336.45, chord distance 37.08, chord bearing N 37-16-11 E) to a point; thence continuing with said right of way line N 34-06-39 E 8.76 feet to a point; thence along a circular curve to the right (length 134.87 feet, radius 1105.92 feet, chord distance 134.78 feet, chord bearing N 37-36-11 E) to an iron pin; thence leaving the eastern right of way of Virginia State Route 653 and crossing Heartwood Forestland Fund V, L.P. (Instrument No. 200601444, reference Tract WI-141) S 47-00-55 E 51.11 feet to an iron pin; thence continuing across Heartwood Forestland Fund V, L.P. (Instrument No. 200601444, reference Tract WI-183) S47-00-55 E 229.23 feet to an iron pin; thence S 47-00-55E 56.00 feet to an iron pin; thence crossing Heartwood Forestland Fund V, L.P. (Instrument No. 200604921, Reference Tract WI-117) S 61-36-57 W 150.77 feet to an iron pin, thence continuing across Heartwood Forestland Fund V, L.P. (Instrument No. 200604921, reference Tract WI-117)S 61-36-57 W 150.77 feet to an iron pin, the point of beginning, containing 1.046 acres, more or less.
BEING the same property conveyed to Davis Watkins, Stephen Stidham and Wayne Dotson, as Trustees of Banner Assembly of God by Deed dated August 3, 2010, and recorded in the Wise County Circuit Court Clerk’s Office as Instrument Number 201002443.
TRACT THREE:
Those certain lots or parcels identified as Lots 36 and 37 on Map of the Town of Banner, Virginia dated October 30, 1946 by E.M. Jones, which plat is of record in Deed Book 201, Page 94 in the Office of the Circuit Court Clerk of Wise County, Virginia, to which reference is hereby made for a more particular description of said property, and bounded as follows: on the northwest by Virginia State Route 653, on the northeast by Lot 38 of the Town of Banner; on the south by property now or formerly of Daniel and Melina Edwards, and on the southwest by Lot 35 of the Town of Banner.
BEING the same property conveyed to Davis Watkins, Stephen Stidham and Wayne Dotson, as Trustees of Banner Assembly of God by Deed dated August 3, 2010, and recorded in the Wise County Circuit Court Clerk’s Office as Instrument Number 201002444.
TRACT FOUR:
All that certain strip or parcel of land lying and being situate on the waters of Lick Branch of Little Tom’s Creek at and near Banner in Lipps Magisterial District of Wise County, Virginia, which is more particularly bounded and described as follows:
Beginning at a dead dogwood near north of and near or at edge of public road, a corner to Rohama Kennedy tract and also corner of lands of Banner Coal Company; thence S 25° 40’ W 848.6 feet to a stake south of old drift mouth of coal mine (Sourwood called), white walnut and chestnut pointers; thence N 73° 30’ W 139 feet to a stake in the line of Norfolk & Western right of way; thence with same N 38° 37’ E 364 feet to a stake; thence running with a 3° curve, following the southerly line of said Norfolk & Western right of way a distance of 353.6 feet to a stake in said right of way line; thence N 24° 57’ E 162.7 feet to a stake in a line of the Rohama Kennedy tract; thence S 73° 45’ E 20.2 feet to the beginning, containing 1.1 acres, more or less.
BEING the same property conveyed to Davis Watkins, Stephen Stidham and Wayne Dotson, as Trustees of Banner Assembly of God by Deed dated September 28, 2009, and recorded in the Wise County Circuit Court Clerk’s Office as Instrument Number 200903184.
TRACT FIVE:
Those certain lots or parcels identified as Lots 35, 38, 39, 40 and 41 on that certain plat of the Town of Banner, Virginia, dated October 30, 1946 by E. M. Jones, which is of record in the Clerk’s Office of the Circuit Court of Wise County, Virginia, in Plat Book 201, at Page 94.
Lot 35 contains 1.386 acres, more or less, and Lots 38, 39, 40 and 41 contain in the aggregate 0.823 acre, more or less, all as set forth on Plat of survey prepared for Heartwood Forestland Fund IV, L.P. dated August 28, 2009, by Glenn F. Phillips & Co., P.C. a copy of which is attached hereto and made a part hereof as if fully set forth herein.
The above described property is hereby conveyed subject to the rights of others to the gravel driveway running through Lot 35 for purposes of ingress and egress, which gravel driveway leads from State Route 653 to property now, or formerly, in the name of Winfred Ray Hamm (Instrument #200300578) as shown on the above reference plat of survey.
BEING the same property conveyed to Davis Watkins, Stephen Stidham and Wayne Dotson, as Trustees of Banner Assembly of God by Deed dated September 28, 2009, and recorded in the Wise County Circuit Court Clerk’s Office as Instrument Number 200903183.
There is also granted to the Grantee the use of any and all easements, right of ways, roadways, water rights, pipeline rights, sewer systems including any field lines attached thereto, in existence and which lawfully may be used by Grantors, whether by express grant, prescriptive use or otherwise, and which are appurtenant to and part of the use and enjoyment of this particular tract of land.
There is also conveyed by this instrument all buildings, improvements, fixtures, easements and appliances now or hereafter attached to or used in connection with the property herein attached.
This conveyance is made subject to all prior recorded conditions, restrictions, reservations, easements and conveyances affecting the property hereby conveyed.

TIME OF SALE: 10:00 A.M.
TERMS OF SALE: CASH. A deposit of 10% in cash or by check will be required of the successful bidder at the time of the sale and settlement in full shall be made within fifteen (15) days from date of sale at the office of said Substitute Trustee. The Substitute Trustee may change the terms of sale on the Date of Sale. The successful bidder will also be required to sign a Memorandum of a Foreclosure Sale.
This is an attempt to collect a debt and any information gathered will be used accordingly.
