NOTICE OF SALE OF
5480 Hale Gap Road
Pound, VA 24279
    WHEREAS, by Deed of Trust dated October 15, 2021, and recorded in the Clerk’s Office of the Circuit Court of Wise, Virginia, by Instrument Number 202104579, Amelia Mullins and Ricky Mullins, wife and husband, conveyed to Diana Hill and Michael Page, Trustee, the hereinafter described real estate to secure the payment of a note in the original principal amount of $120,000.00.
    WHEREAS, the undersigned was appointed and substituted as Substitute Trustee under this Deed of Trust by a substitution dated January 13, 2025, and recorded in the Office of the Register of Deeds for Wise, Virginia by Instrument Number 202500130.
    WHEREAS, default has been made in the payment of said indebtedness and other provisions of the Deed of Trust have been violated, and Eastman Credit Union, the holder of said indebtedness has declared the entire amount due and payable as provided in said Deed of Trust, and the Substitute Trustee has been directed to foreclose the Deed of Trust in accordance with the terms thereof; and 
   WHEREAS, the public is hereby notified that the undersigned Substitute Trustee will sell the hereinafter described real estate at public auction, to the highest and best bidder, for ten percent down with the remainder due at closing within 20 days of sale, at the main entrance of Wise County Courthouse, 206 East Main Street, Wise, Virginia, at 1:00 p.m. on March 28, 2025.
     All that certain tract, piece or parcel of land, together with all improvements thereon, lying in Flat Gap Section of Roberson Magisterial District in Wise County, Virginia, and on the waters of North Fork of Pound River, and more particularly bounded and described as follows, to wit:
    BEGINNING at a stake, a corner to the lands owned by Charles Roberts, and from thence with the river near this corner in a near East direction and as the river meanders to a stake, a corner to the Lloyd and Margie Riddle line; thence up the hill to a stake at the State Highway; thence with highway line up the mountain to a stake in the highway line; thence down the hill at right angle to said highway to a stake in the “Old County Road” thence with said old roadway to a stake on the bank of the present State Highway; thence with the highway line stake and corner tree marked at the before referred to Roberts’ line; thence down the hill with said line and crossing the highway to the point of beginning, containing eight (8) acres by the boundary and not by survey.
     BEING the same property conveyed to Joshua P. West by Deed dated July 19, 2000 and recorded in the Wise County Circuit Court Clerk’s Office as Instrument Number 200002807.
    THERE IS FURTHER CONVEYED the 2006 Norris Manufactured Home, Title Number 88381587, Vehicle ID N01031208TNAB.
     There is also granted to the Grantee the use of any and all easements, right of ways, roadways, water rights, pipeline rights, sewer systems including any field lines attached thereto, in existence and which lawfully may be used by Grantors, whether by express grant, prescriptive use or otherwise, and which are appurtenant to and part of the use and enjoyment of this particular tract of land.
    There is also conveyed by this instrument all buildings, improvements, fixtures, easements and appliances now or hereafter attached to or used in connection with the property herein attached.
    This conveyance is made subject to all prior recorded conditions, restrictions, reservations, easements and conveyances affecting the property hereby conveyed.

     The sale will be made without covenant or warranty regarding title, possession, easements, restrictive covenants, or encumbrances, in bar of all rights and equity of redemption waived in the deed of trust, and subject to all other rights or exemptions of the grantors in said deed of trust.
