IN EXECUTION of a Deed of Trust dated the 29th day of November, 2013, in principal amount of $80,764.50, recorded in the Clerk's Office of the Circuit Court for Wise County, Virginia, as Instrument Number 201303940, modified by Instrument No. 202104209, default having occurred thereunder, and having been requested to do so by the Beneficiary, the undersigned Trustee will offer for sale at public auction at the Front Door of the Wise County Courthouse, 206 E. Main Street, in the Town of Wise, Virginia, [NOTICE: THIS SALE WILL NOT TAKE PLACE ON THE PREMISES OF THE PROPERTY BEING SOLD]

on the 20th day of May, 2024, at 10:30 A.M.

All that certain tract or parcel of land, together with all improvements situate thereon, lying and being situated in the Crab Orchard section, in the Lipps Magisterial District of Wise County, Virginia, more particularly bounded and described as follows, to-wit:

BEING a 0.754 acre parcel of land (Tract #2) situated in the Crab Orchard Section of Coeburn, Wise County, Virginia, and being part of the same property conveyed to Robert Branch, Sr., and recorded in Instrument #200004318, in the Wise County Clerk's Office and being further described as follows, to-wit: BEGINNING at an iron pin in the Western line of Billy Willis (Deed Book 717, Page 462) thence with new division line with Tract #1 two (2) calls N 63 22' 32" W 365.36' to an iron pin, thence N 49 40' 09" W 44.05' to an iron pin, thence leaving said Tract #1 N 16 19' 12" E 60.56' to a power pole a common corner to Floyd Adams (Deed Book 710 Page 71) said power pole bears S

66 47' 42" E 35.39' to an iron pin, thence with Adams S 66 40' 38" E 400.21' to an iron pin in line of aforesaid Willis, thence with same S 14 49' 20" W 95.08' to the Beginning, containing 0.754 acres, as shown on “Plat Prepared For: Robert Branch, Sr.” by Joseph Barger, CLS 1177, dated November 8, 2000, which said Plat is attached hereto and incorporated herein by reference.

BEING that same property conveyed unto Grantor by Deed dated May 16, 2012, and recorded as Instrument No. 201201582 in the Clerk's Office for Wise County, Virginia, reference to which said Deed is hereby made.

There is also granted to the Grantee the use of any and all easements, right of ways, roadways, water rights, pipeline rights, sewer systems including any field lines attached thereto, in existence and which lawfully may be used by Grantors, whether by express grant, prescriptive use or otherwise and which are appurtenant to and part of the use and enjoyment of this particular tract of land.

There is also conveyed by this instrument all buildings, improvements, fixtures, easements and appliances now or hereafter attached to or used in connection with the property herein attached.

This Deed is made subject to any and all existing reservations, easements, exceptions, conditions, restrictions and/or adverse conveyances as the same may lawfully affect the above-described property.

TERMS OF SALE: Cash. A deposit of 10% of the sale price in cash or certified check may be required at the time and place of sale with the balance of the sale price to be paid at settlement, to be held within THIRTY (30) days from the date of the sale; should purchaser fail to complete purchase within 30 days, the deposit is forfeited and the sale subject to termination or a charge of daily per diem interest thereon until closing date at option of Lienholder. The property and any improvements thereon shall be sold in "AS IS, WHERE IS" condition without any warranties. Title shall be transferred by Special Warranty Deed, and Buyer shall be responsible for all costs of conveyance including but not limited to deed preparation and all fees to transfer title. Sale is subject to such additional terms as Trustee may announce at the sale.

This is an attempt to collect a debt and any information obtained will be used for that purpose.
