The object of this suit is to enforce the lien of the Complainant, County of Wise, Virginia, for delinquent real estate taxes against certain real property located in the County of Wise, Virginia, described as follows:

Tax Map No. 081 ( ) 020

Account No. 015720

All that certain tract or parcel of land, lying and being in the Richmond Magisterial District, Wise County, Virginia, containing 0.73 acre, more or less, and more particularly described as follows:

Beginning at a set stone in the line of land now or formerly owned by D.H. Fisher; thence N 72-27 W 135 feet, passing a set stone at 107.2 feet, to a stake in the center of the public road; thence with the center of said road, S 9-59 W 267.5 feet to a stake; thence S 29-54 W 98.2 feet to a stake on the property line of the tract of land which this is a portion thereof and with the same leaving said road, S 59-19 E 21.5 feet to a set stone on the north right of way line of the Southern Railway Company and with the same N 43-59 E 42.1 feet to a stake; thence with curve left 194.2 feet; thence leaving said right of way line and with a line of the said Fisher, N 17-23 E 152.1 feet to the beginning.

And being the same property conveyed to Joe A. Kern and Alma Ruth Kern, his wife, jointly for their joint lives with the remainder upon the death of either to the survivor in fee simple, from Ewell Kenneth Fisher and Carolyn Yose Fisher, his wife, by Deed dated and recorded July 15, 1969, in the Clerk’s Office of the Circuit Court of Wise County, Virginia, in Deed Book 419, at Page 496.

This description is made subject to all easements, conditions, agreements, restrictions, and reservations of record which affect the property herein described.

IT APPEARING that an Affidavit has been made and filed stating that due diligence has been used, without effect, to ascertain the identity and location of certain parties to be served, that the last known addresses for the Respondents herein are as follows: Joe A. Kern, who is believed to be deceased and whose last known address is 320 Sloantown Road, Duffield, Virginia 24244; Alma Ruth Kern, who is believed to be deceased and whose last known address is 722 Fisher Road, Big Stone Gap, Virginia 24219; Donald Perry Kern, who is believed to be deceased and whose last known address is RR 7 1600, Gate City, Virginia 24251; James Darrell Kern, who is believed to be deceased and whose last known address is 417 Whitney Road, Mocksville, North Carolina 27028; Tyler Kern, whose last known address is 417 Whitney Road, Mocksville, North Carolina 27028; Billy Joe Shupe, who is believed to be deceased and whose last known address is 416 Countryshire Circle, Hiltons, Virginia 24258; Barbara J. Shupe, whose last known address is 416 Countryshire Circle, Hiltons, Virginia 24258; and that any officers, heirs, devisees, and successors in title of the Respondent named herein are made parties Respondent to this action individually and/or by the general description of Parties Unknown, it is hereby

ORDERED that the parties herein and all Parties Unknown and/or whose location cannot be ascertained appear on or before April 30, 2025 in the Clerk’s Office of the Circuit Court of the County of Wise, Virginia, and do what may be necessary to protect their interests in this cause.
