The object of this suit is to enforce the lien of the Complainant, County of Wise, Virginia, for delinquent real estate taxes against certain real property located in the County of Wise, Virginia, described as follows:

Account No. 009872

All that certain tract or parcel of land, lying and being in the Hurricane Section in the Gladeville Magisterial District of Wise County, Virginia, on the north side of Yellow Creek, containing 0.5 acres, more or less.

And being the same property conveyed to Mary Collins aka Mary E. Collins and Mitchell Collins aka Robert Mitchell Collins from Ira Jessee, widower, by Deed dated July 22, 1966, and recorded February 3, 1967, in the Clerk's Office of the Circuit Court of Wise County, Virginia, in Deed Book 401, at Page 207.

And further being the same property in which a one-half interest in the above-described property was devised to Ronald Dwayne Collins pursuant to the Last Will and Testament of Mary E. Collins dated February 2, 2012, and recorded August 14, 2012, in the aforementioned Clerk's Office as Instrument Number 120000246.

This description is made subject to all easements, conditions, agreements, restrictions, and reservations of record which affect the property herein described including but not limited to those recorded in Deed Book 401, at Page 207 and Instrument Number 201805986.

All that certain tract or parcel of land, together with improvements thereon and appurtenances thereunto belonging, lying and being in the Gladeville Magisterial District of Wise County, Virginia, and more particularly bounded and described as follows, to-wit:

Being known and designated as Lots 1, 2, 3, 4, 5, and 6 of Block 2; Lots 1, 2, 3, 4, 5 of Block 4; Lots 1 through 11 of Block 5, as shown on the “Map Showing Subdivision of the E.F. Beverly Land”, prepared by C. Sterling Jones, Engineer, dated June 10, 1953, of record in the Clerk's Office of the Circuit Court of Wise County, Virginia, in Deed Book 201, at Page 136, said portions bounded and described as follows: Beginning at a stake at the eastern corner of Horizon Road (formerly Bob Street) and the now nonexistent Emmett Street and a corner to property now or formerly owned by Jonathan Paul Hunsaker; thence S 77 15 W 227.2 feet to a stake at a corner of the now nonexistent Minnie Street; thence with the now nonexistent line of Minne Street, N 23 30 W 537.0 feet to the corner of Lot No. 1; thence N 23 30 W 132.0 feet to a stake; thence with the northern corner of Block No. 5, N 38 E 392.0 feet to a stake in the northeast corner of Lot No. 6; thence with the line of Lot No. 6, S 23 E 184.2 feet to a stake in the line of Lot No. 7; thence N 74 45 E 178.0 feet to a stake in the corner of Lot No. 11; thence S 41 30 E 197.0 feet to a stake; thence with the line of the now nonexistent Floyd Street, S 78 E 132.0 feet to a stake; thence N 72 E 44.0 feet to a stake at the corner of the now nonexistent Ira Street; thence S 41 15 E ___ to a stake at the corner of Lot No. 6; thence with the line of the said Horizon Street (formerly Nola Street), 384.6 feet to a stake at the corner of the now nonexistent Jink Street; thence with the northern line of Horizon Road (formerly Nola Street) and the southern line of the now nonexistent Jink Street to a stake at the southeast corner of Lot No. 2, in Block 3; thence with the line of Horizon Road (formerly Bob Street) in a southwestern direction to the point of beginning, containing 5.5 acres, more or less.

And being a portion of the same property conveyed to Mary Collins aka Mary E. Collins and Mitchell Collins aka Robert Mitchell Collins from Gilmer Jessee and Frampton Jessee, his wife, by Deed dated July 5, 1966, and recorded February 3, 1967, in the Clerk's Office of the Circuit Court of Wise County, Virginia, in Deed Book 401, at Page 209.

And further being the same property conveyed to Mary Collins aka Mary E. Collins from Mitchell Collins aka Robert Mitchell Collins by Deed dated November 30, 1972, and recorded November 18, 1974, in the aforementioned Clerk's Office in Deed Book 470, at Page 183.

And further being the same property devised to Ronald Dwayne Collins pursuant to the Last Will and Testament of Mary E. Collins dated February 2, 2012, and recorded August 14, 2012, in the aforementioned Clerk's Office as Instrument Number 120000246.

This description is made subject to all easements, conditions, agreements, restrictions, and reservations of record which affect the property herein described including but not limited to those recorded in Deed Book 401, at Page 209, Deed Book 470, at Page 183, and Instrument Number 201805986.

All that certain tract or parcel of land, together with improvements thereon and appurtenances thereunto belonging, lying and being in the Greenbriar Acres Subdivision in the Gladeville Magisterial District of Wise County, Virginia, more particularly bounded and described as follows, to-wit:

Being known and designates as all of Lot Nos. 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, and 13 of Block 2 of the Greenbriar Acres Subdivision, as shown on a plat recorded in the Clerk's Office of the Circuit Court of Wise County, Virginia, in Plat Book 6, at Page 4, to which reference is hereby made for a more complete description of the property herein described.

And being the same property conveyed to Mary E. Collins and Robert Mitchell Collins from Stephen J. Kalista, Special Commissioner, by Deed dated June 8, 1994, and recorded April 18, 1995, in the Clerk's Office of the Circuit Court of Wise County, Virginia, in Deed Book 799, at Page 759.

And further being the same property conveyed to Mary E. Collins from Mary E. Collins and Robert Mitchell by Deed dated April 7, 1995, and recorded July 5, 1995, in the aforementioned Clerk's Office in Deed Book 805, at Page 147.

And further being the same property devised to Ronald Dwayne Collins pursuant to the Last Will and Testament of Mary E. Collins dated February 2, 2012, and recorded August 14, 2012, in the aforementioned Clerk's Office as Instrument Number 120000246.

This description is made subject to all easements, conditions, agreements, restrictions, and reservations of record which affect the property herein described including but not limited to those recorded in Deed Book 429, at Page 672, Deed Book 648, at Page 568, Deed Book 805, at Page 147, and Instrument Number 201805986.

IT APPEARING that an Affidavit has been made and filed stating that due diligence has been used, without effect, to ascertain the identity and location of certain parties to be served, that the last known addresses for the Respondents herein are as follows: Ronald Dwayne Collins, whose last known address is 1062 Morning Star Road, Church Hill, Tennessee 37642; Gary M. Collins, who is believed to be deceased and whose last known address is 763 Cummings Street, Abingdon, Virginia 24211; Frampton C. Morton, whose last known address is 4831 Orchard Drive, Big Stone Gap, Virginia 24219; and that any officers, heirs, devisees, and successors in title of the Respondent named herein are made parties Respondent to this action individually and/or by the general description of Parties Unknown, it is hereby

ORDERED that the parties herein and all Parties Unknown and/or whose location cannot be ascertained appear on or before August 2, 2024 in the Clerk's Office of the Circuit Court of the County of Wise, Virginia, and do what may be necessary to protect their interests in this cause.
