In execution of that certain Deed of Trust dated August 21, 2020, and recorded in the Circuit Court Clerk's Office of Wise County, Virginia on September 01, 2020, as Instrument Number 202003523, and by virtue of the authority vested in the undersigned Substitute Trustee, any one of whom may act, by said Deed of Trust, and the Deed of Appointment of Substitute Trustee recorded in the Circuit Court Clerk's Office of Wise County, Virginia as Instrument Number 202204344, default having been made in the terms of the Note secured by the Deed of Trust, and having been requested to do so by the Holder of the Note, the undersigned Substitute Trustee will offer for sale at public auction the following property as described in said Deed of Trust:
All the surface, together with the improvements thereon of the following described lot, tract or parcel together with improvements situate thereon and appurtenances thereto appertaining, located in the Village of Imboden, in the RICHMOND MAGISTERIAL DISTRICT of Wise County, Virginia, and being more particularly bounded and described as follows:
House and Lot No. 206, BEGINNING at a fence post, front corner of Lots No. 206-207, having Stonega Coke and Coal Company coordinates N 20095.41 - E 47824.12; thence N 14-10 E 65.80 feet to a post; thence N 58-00 E 54.02 feet to a post; thence S 26-08 E 61.34 feet to a post; thence S 77-41 W 8.25 feet to a post; thence N 75-42 W 65.70 feet to the point of BEGINNING, containing 0.147 acre, more or less.
There is EXCEPTED and RESERVED all the coal, oil, gas and other minerals underlying the surface of the above described tract or parcel of land, together with the free and uninterrupted right of way into and under said described premises, for the purpose of mining and removing and carrying away all of said coal, oil, gas and other minerals, without being liable for damages for any injury that may be done to the overlying strats or anything therein or thereon, or for destroying or diverting the waterflow by reason of the mining and removal of all of said coal, oil, gas and other minerals and with the privilege of carrying through the openings in said land, coal, oil, gas or other minerals from other tracts, or any other thing or material which may now or hereafter be owned by the party of the first part, its successors or assigns.
Also EXCEPTING and RESERVING an easement for all water, drainage, sewerage, telephone and electric pipes or wires, together with the right to maintain repair, replace or remove the same.
THERE IS ALSO GRANTED to the Grantee the use of any and all easements, rights of ways, roadways, water rights, pipeline rights, sewer systems, including field lines attached thereto, in existence and which lawfully may be used by Grantor, whether by express grant, prescriptive use or otherwise and which are appurtenant to and part of the use and enjoyment of this particular tract of land.
THIS DEED IS MADE SUBJECT to any and all existing reservations, easements, conditions, exceptions, restrictions and/or adverse conveyances as the same may lawfully affect the above described property.
THERE IS ALSO CONVEYED BY THIS INSTRUMENT all buildings, improvements, fixtures, appliances and/or easements, now or hereafter attached to or used in connection with the property herein-above described.
BEING the same property Michael Gilliam acquired by deed dated August 6, 2020, from Virginia L. Barton, of record in the Circuit Court Clerk's Office of Wise County, Virginia, as Instrument No. 202003344.

TIME OF SALE: 9:00 a.m.
TERMS OF SALE: CASH. A deposit of 10% in cash or by check will be required of the successful bidder at the time of the sale and settlement in full shall be made within fifteen (15) days from date of sale at the office of said Substitute Trustee. The Substitute Trustee may change the terms of sale on the Date of Sale. The successful bidder will also be required to sign a Memorandum of a Foreclosure Sale.
This is an attempt to collect a debt and any information gathered will be used accordingly.
