The object of this suit is to enforce the lien of the Complainant, County of Wise, Virginia, for delinquent real estate taxes against certain real property located in the County of Wise, Virginia, described as follows:

All that certain tract or parcel of land in Riverview, Lipps Magisterial District, Wise County, Virginia, which is more particularly designated as Lot Nos. 21 and 22, and further described as follows:

Lot No. 21 fronts 50 feet on the north side of Essex Street (formerly McConnell Street) and runs back 150 feet to an alley. Lot No. 22 fronts sixty feet on the north side of Essex Street (formerly McConnell Street) and runs back 150 feet to an alley.

And being the same property conveyed to Mary Garrison aka Mary G. Kilgore from Estes Kilgore by Deed dated and recorded September 20, 1954, in the Office of the Circuit Court Clerk of Wise County, Virginia, in Deed Book 321, at Page 190. The said Mary Garrison aka Mary G. Kilgore died August 4, 1992, and pursuant to her Last Will and Testament dated May 12, 1989, and recorded August 13, 1992, in the aforementioned Clerk's Office in Will Book 74, at Page 450, Mary Garrison aka Mary G. Kilgore devised the above-described property to C.W. Kilgore aka Charles W. Kilgore and Sudorthia Sue Kilgore aka Sue B. Kilgore.

And further being the same property devised to Sudorthia Sue Kilgore aka Sue B. Kilgore, for her life, pursuant to the Last Will and Testament of C.W. Kilgore aka Charles W. Kilgore dated January 29, 1993, and recorded June 21, 1994, in the aforementioned Clerk's Office in Will Book 78, at Page 745.

All that certain tract or parcel of land, lying and being in the Lipps Magisterial District, Wise County, Virginia, and more fully described as follows:

Being Lot No. 10 in Block 1 of the Mills Addition to Riverview, a village about one and a half miles southwest of Coeburn, Virginia.

And being the same property conveyed to C.W. Kilgore aka Charles W. Kilgore and Sudorthia Sue Kilgore aka Sue B. Kilgore, as tenants by the entirety with the right of survivorship, from Bobby Joe Abbott and Eunice Raye Abbott by Deed dated March 27, 1975, and recorded June 11, 1975, in the Office of the Circuit Court Clerk of Wise County, Virginia, in Deed Book 476, at Page 163. The said C.W. Kilgore aka Charles W. Kilgore died May 26, 1994, passing his interest in the above-described property to his wife, Sudorthia Sue Kilgore aka Sue B. Kilgore, via operation of law.

Lot No. 12: Fronting 50 feet on Essex Street (formerly McConnell Street) and extending back with Buckingham Road (formerly Kilgore Street) 150 feet to an alley.

Lot No. 13: Lying and being in Block No. 1 in the L.J. McConnell Addition on the west side of Buckingham Road (formerly Kilgore Street) and on the north side of Essex Street (formerly McConnell Street); beginning at a stake about 60 feet from the center of Essex Street in a western direction 50 feet to the corner of the lot now or formerly owned by J.P. Currin to an alley now or formerly owned by Linkous; thence in an eastern direction with the south side of said alley 50 feet to a stake; thence in a southern direction to the point of beginning.

And being the same property conveyed to C.W. Kilgore aka Charles W. Kilgore and Sudorthia Sue Kilgore aka Sue B. Kilgore, his wife, as tenants by the entirety with right of survivorship, from C.W. Kilgore aka Charles W. Kilgore and Sudorthia Sue Kilgore aka Sue B. Kilgore, his wife, by Deed dated May 28, 1985, and recorded August 24, 1987, in the Office of the Circuit Court Clerk of Wise County, Virginia, in Deed Book 648, at Page 426. The said C.W. Kilgore aka Charles W. Kilgore died May 26, 1994, passing his interest in the above-described property to his wife, Sudorthia Sue Kilgore aka Sue B. Kilgore, via operation of law.

Kilgore, widow, from Clyde Brummitt and Louise Brummitt, his wife, by Deed dated September 12, 1994, and recorded January 16, 1996, in the Office of the Circuit Court Clerk of Wise County, Virginia, in Deed Book 816, at Page 745.

Tract No. 1: Beginning at a stake in the north edge of a 12-foot alley, at the intersection of Mitchell Road (formerly Michael Street); thence with said Mitchell Road in a northwardly direction 50 feet to a stake; thence in an eastwardly direction and parallel with said alley, 194 feet to a stake in the line of land now or formerly owned by O.J. Linkous or formerly known as the Williams Lot; thence with said alley in a westwardly direction, 194 feet to the point of beginning, containing 0.25 acre, more or less.

Tract No. 2: Being Lot No. 20, fronting 50 feet on the north side of Essex Road (formerly McConnell Street), and running back between parallel lines a distance of 150 feet to an alley, adjoining the property now or formerly owned by R.L. Rose and John Miller.

Tract No. 3: All that certain lot, piece, or parcel of land, in Riverview, in Lipps Magisterial District, in Wise County, Virginia, assessed in the name of Sudorthia Sue Kilgore and Eric A. Kilgore, et als., and being known on the Tax Rolls of Wise County, Virginia, as Tax Map Number 054D (01) 021 002, Account Number 009642.

Being the same property conveyed to Mary Garrison Kilgore from Emory W. Sigman and Carol Sigman, his wife, by Deed dated and recorded July 18, 1988, in the Office of the Circuit Court Clerk of Wise County, Virginia, in Deed Book 663, at Page 369.

Tract No. 4: Beginning at a stake in the north edge of a 12-foot alley, at the intersection of Mitchell Road (formerly Michael Street); thence running with said road 50 feet to a corner with property now or formerly owned by J.M. Quillen, Jr., thence running with the said J.M. Quillen, Jr. line 121 feet to a corner with the said J.M. Quillen, Jr. and property now or formerly owned by E.W. Sigman; thence 50 feet to an alley, a corner on said alley; thence running with said alley 121 feet to the beginning.

Being the same property conveyed to Mary Garrison Kilgore from Alta E. Fuller, widow, by Deed dated September 29, 1975, and recorded October 2, 1975, in the Office of the Circuit Court Clerk of Wise County, Virginia, in Deed Book 480, at Page 609.

The said Mary Garrison Kilgore died August 4, 1992, and pursuant to her Last Will and Testament dated May 12, 1989, and recorded August 13, 1992, in the aforementioned Clerk's Office in Will Book 74, at Page 450, Mary Garrison aka Mary G. Kilgore devised the above-described property to C.W. Kilgore aka Charles W. Kilgore and Sudorthia Sue Kilgore aka Sue B. Kilgore. The said C.W. Kilgore aka Charles W. Kilgore died May 26, 1994, and pursuant to his Last Will and Testament dated January 29, 1993, and recorded June 21, 1994, in the aforementioned Clerk's Office in Will Book 78, at Page 745, C.W. Kilgore aka Charles W. Kilgore devised his interest in the above-described property to his wife, Sudorthia Sue Kilgore aka Sue B. Kilgore, for her life.

And further being the same property conveyed to Sudorthia Sue Kilgore aka Sue B. Kilgore from Sue Kilgore aka Sue B. Kilgore by Deed of Gift dated and recorded February 3, 2004, in the Office of the Circuit Court Clerk of Wise County, Virginia, as Instrument Number 200400410.

IT APPEARING that an Affidavit has been made and filed stating that due diligence has been used, without effect, to ascertain the identity and location of certain parties to be served, that the last known addresses for the Respondents herein are as follows: Sudorthia Sue Kilgore aka Sue B. Kilgore, whose last known address is 2205 Applegrove Street NW, North Canton, Ohio 44720; Sharon Lee Reece, who is believed to be deceased and whose last known address is P.O. Box 535, Wise, Virginia 24293; Richard D. Icenhour, whose last known address is 200 W. Grand Avenue, Apt. 306B, Englewood, Colorado 80110; Edgar Kilgore aka Eddie M. Kilgore, whose last known address is 2543 Winfield Way NE, Canton, Ohio 44705; and that any officers, heirs, devisees, and successors in title of the Respondent named herein are made parties Respondent to this action individually and/or by the general description of Parties Unknown, it is hereby

ORDERED that the parties herein and all Parties Unknown and/or whose location cannot be ascertained appear on or before April 27, 2023 in the Clerk's Office of the Circuit Court of the County of Wise, Virginia, and do what may be necessary to protect their interests in this cause.
