In execution of a Deed of Trust in the original principal amount of $114,500.00, dated January 3, 2015 recorded in the Clerk's Office of the Circuit Court of the Wise County, Virginia, in Document No. 201500103, and modified in Document No. 201805104, at the request of the holder of the Note, the undersigned Substitute Trustee will offer for sale at public auction at the entrance to the Circuit Court of Wise County, 206 East Main Street, Wise, on November 28, 2022 at 12:00 PM the property described in said deed, located at the above address and briefly described as:
BEGINNING at a hickory at the J. H. Cantrell line, a corner to C. R. Browning's land; thence with the Browning line S 67 05 W 138.13 feet to a poplar and dogwood; thence S 67 21 W 113.27 feet to a stake at the edge of a spoil bank; thence S 89 01 W 175.29 feet to an iron pin on a strip-mine area; thence N 82 50 W 173.82 feet to another iron pin on said stripped area; thence N 85 28 W 238.06 feet to a stake on said stripped area; thence leaving said Browning line and with the property of H. Cantrell S 13 58 W 36.54 feet to a stake on said stripped area; thence S 67 35 E 581.07 feet to a stake at the edge of the roadway; thence N 75 55 E 312.40 feet to a stake; thence N 3 14 W 242.41 feet to the point of Beginning, with any improvements thereon
Subject to any and all covenants, conditions, restrictions, easements, and all other matters of record taking priority over the Deed of Trust, if any, affecting the aforesaid property.
TERMS OF SALE: CASH: A deposit of $20,000.00 or 10% of the sales price, whichever is lower, cash or certified check will be required at the time of sale, but no more than $10,000.00 of cash will be accepted, with settlement within fifteen (15) days from the date of sale. Sale is subject to post sale confirmation that the borrower did not file for protection under the U.S. Bankruptcy Code prior to the sale which affects the validity of the sale, as well as to post-sale confirmation of the status of the loan with the loan servicer including, but not limited to, determination of whether the borrower entered into any repayment agreement, reinstated or paid off the loan prior to the sale. In any such event, the sale shall be null and void, and the Purchaser's sole remedy, in law or equity, shall be the return of his deposit without interest. Additional terms may be announced at the time of sale.
