IN EXECUTION of a Deed of Trust dated the 15th day of August, 2018, in principal amount of $82,500.00, recorded in the Clerk's Office of the Circuit Court for Wise County, Virginia, as Instrument Number 201804013, default having occurred thereunder, and having been requested to do so by the Beneficiary, the undersigned Substitute Trustee who was appointed under Instrument No. 202005001, will offer for sale at public auction at the Front Door of the Wise County Courthouse, 206 E. Main Street, in the Town of Wise, Virginia, [NOTICE: THIS SALE WILL NOT TAKE PLACE ON THE PREMISES OF THE PROPERTY BEING SOLD]

the following described property situate, lying and being in the Town of Wise, Wise County, Virginia, and more particularly bounded and described as follows, to-wit:
All that certain lot, piece or parcel of land situate, lying and being in the Town of Wise, Wise County, Virginia, near the Fair Grounds, on the old Hurricane Road, and more particularly bounded and described as follows, to-wit:
BEGINNING at a stake on the Old Hurricane Road at G.W. Falin's line in an easterly direction, and following the Old Hurricane Road 175 feet to a stake in the line of the Old Hurricane Road at a hub near an alley; thence in a southwesterly direction with the Old Hurricane Road 176 feet to the L.J. Laney line; thence in the northwestwardly direction with said Laney's line 186 feet to Yellow Creek; thence with said Yellow Creek in a northwestwardly direction 194 feet to the point of BEGINNING, containing one-half (1/2) acre, more or less.
There is EXCEPTED AND RESERVED from the operation of this conveyance that part of said lot as was heretofore conveyed by Charlie Green and Wife, Margaret Green, unto Audrey Welch by Deed dated December 16, 1971, and of record in the Clerk's Office of Wise County, Virginia in Deed Book 439, Page 499, reference to which said Deed is hereby made for a more full and complete description of said lots so excepted.
BEGINNING at a stake in the Old Hurricane Road, a corner to Irene Crabtree; thence in a northwardly direction with the line of Old Hurricane Road 20 feet to a stake in the J.C. and Jo Ann Greene line; thence in a southwestwardly direction 196 feet to the Jimmy Beverly line; thence with the Beverly line in a southwardly direction 20 feet to Irene Crabtree line; thence with the Crabtree line in an eastwardly direction 196 feet to the point of BEGINNING.
All that certain lot or parcel of land situate in the Town of Wise, Wise County, Virginia, and more particularly bounded and described as follows:
BEGINNING at a point in the center of Yellow Creek and in the southwest edge of Gilliam Street, said point bears N 43° 20' 00" W 5.00' to an iron pin, thence with said southwest edge of Gilliam Street, S 43° 20' 00" E 19.93' to an iron pin, a common corner to Charlene Foster and Kelly Foster (DB 600, Page 550) thence with same S 31° 06' 16" W 139.91' thence N 49° 32' 22" W 5.32' to a point in Yellow Creek, said point bears N 49° 32' 22" E 10.00' to an iron, thence with new division lines and up Yellow Creek four (4) calls N 36° 24' 46 E 16.60' thence N 21° 31' 25" E 28.59' thence N 07° 29' 49" E 21.35' thence N 29° 34' 39" E 80.09' to the Beginning containing 0.043 acre.
BEING that same property conveyed unto Grantor by Deed dated August 14, 2018, recorded as Instrument No. 201804012 in the Clerk's Office for Wise county, Virginia, reference to which said Deed is hereby made.
There is also granted to the Grantee the use of any and all easements, right of ways, roadways, water rights, pipeline rights, sewer systems including any field lines attached thereto, in existence and which lawfully may be used by Grantors, whether by express grant, prescriptive use or otherwise and which are appurtenant to and part of the use and enjoyment of this particular tract of land.
There is also conveyed by this instrument all buildings, improvements, fixtures, easements and appliances now or hereafter attached to or used in connection with the property herein attached.

TERMS OF SALE: Cash. A deposit of 10% of the sale price in cash or certified check may be required at the time and place of sale with the balance of the sale price to be paid at settlement, to be held within THIRTY (30) days from the date of the sale; should purchaser fail to complete purchase within 30 days, the deposit is forfeited and the sale subject to termination or a charge of daily per diem interest thereon until closing date at option of Lienholder. The property and any improvements thereon shall be sold in "AS IS, WHERE IS" condition without any warranties. Title shall be transferred by Special Warranty Deed, and Buyer shall be responsible for all costs of conveyance including but not limited to deed preparation and all fees to transfer title. Sale is subject to such additional terms as Trustee may announce at the sale.
There is a manufactured home situate on a permanent foundation on the above described property which is to be sold.
