NOTICE OF SUBSTITUTE TRUSTEE'S SALE
WHEREAS, by Deed of Trust dated May 26, 2016, of record in the Clerk's Office of the Circuit Court of Wise County, Virginia, Instrument No. 201602530, Jessee Tyler Caldwell conveyed the real estate hereinafter described to Jeff Sturgill, as Trustee, for the benefit of Southern Finance Mortgage Corp., to secure the payment of the debt therein fully and definitely described; and
WHEREAS, by Deed of Appointment and Designation dated January 8, 2021, of record in said Wise County, Virginia, Clerk's Office as Instrument No. 202100231, David J. Hutton and/or Daniel S. Robinson were substituted as Trustees herein; and
WHEREAS, default has been made in the payment of the debt secured by the Deed of Trust and the undersigned Substitute Trustee has been requested by the holder of the Note to foreclose the lien of said Deed of Trust by sale of the hereinafter described property; and
NOW, THEREFORE, NOTICE is hereby given that on Friday, March 12, 2021 at 10:00 a.m., the undersigned will offer for sale at public auction by special warranty deed to the highest bidder for cash at the main public entrance in the rear garage area of the Wise County Courthouse, the address for which is 206 E. Main Street Wise, Virginia, the following tract or parcel of land:
Lying and being in Wise County, Virginia in the Town of East Stone Gap, and more particularly designated and described as follows, to-wit:
BEING lots 3 and 4 and 2-1/2 feet off of Lot 5 adjoining said Lot 4, all of said lots and parts thereof being in Block 10 on a plat of said town marked “East Big Stone Gap, VA Plat No. 1”, of the East Big Stone Gap Land and Improvement Company's Property; the said lots and parts hereby conveyed are together a rectangular shape fronting 52 1/2 feet on Flat Street on the south side thereof, and running back therefrom between parallel lines 125 feet to the north side of 14 feet wide alley.
Being that same certain tract or parcel of land heretofore conveyed to Gene E. Caldwell and Sharon Renee Caldwell (Renee being erroneous in Prior Deed), his wife, as tenants by the entirety with the right of survivorship as at common law, by deed dated June 12, 1999, from Glenna P. Wood and William S. Parsons, Jr., of record in the Clerk's Office of the Circuit Court for Wise County, Virginia, as Instrument Number 990002763 and being the same property conveyed to Jessee Tyler Caldwell by deed dated January 28, 2014 of record in the aforesaid clerk's office as Instrument Number 201400582

The sale is subject to the conditions, covenants, restrictions, reservations, party wall rights, easements, right of way and other matters of record applicable to the property, and real estate taxes from the date of the sale.

TERMS OF SALE: 10 percent down in cash, cashier's check, certified check or postal money order with balance in cash at closing within 30 days. In the event of default by the purchaser, the deposit shall be forfeited and applied to the costs and expenses of sale and the Trustee's compensation authorized by the Deed of Trust and the law in such cases.
All costs of conveyance, which shall be by special warranty deed, examination of title, recording taxes, notary fees, settlement fees and grantor's tax, to be at the cost of the purchaser.
The Trustee reserves the right to reject all bids and withdraw the property from sale, waive the deposit requirements in whole or in part, and extend the period of time in which the purchaser is to make full settlement. Additional terms of sale may be announced at the sale.
