Red River Coal Company, Inc., P.O. Box 668, Norton, Virginia 24273 is applying to the Virginia Division of Mined Land Reclamation for Pursuant to Section 4 VAC 25-130-800.40 and 4 VAC 25-130-801.17 for Phase II Bond Reduction on Increments No.3, No.4, No.6, No.7 and No.8 which has met the post-mining land use of unmanaged forest on Permit Number 1100033 at the following location:

Approximately nine miles north of Norton in Wise County, near the headwaters of Guest River. The permit area can be reached by turning west off Rt. 620 approximately 1.2 miles north of the intersection of Rt. 620 and 701. The permit area covers 826.21 acres on the eastern slope of Indian Mountain between Fox Gap and Powell River.

The permit area is located on the Flat Gap, VA-KY USGS quadrangle map.

This permit consists of 826.21 acres, which are bonded for $1,052,400.00 in form of insurance surety and is covered under the Virginia Coal Surface Mining Reclamation Fund. As provided by §4VAC 25-130-800.40 and §4VAC 25-130-801.170 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting a Phase II bond reduction of $400,600.00 on Increment No.3, No.4, No.6, No.7 and No.8 consisting of 516.22 acres; backfilling and regarding requirements have been met. The vegetation has had 3 growing seasons. The reclamation work was completed on 9/2017 more than two years prior to the filing of this application.

Any person with a valid legal interest which might be adversely affected by this proposal, or an officer or head of any federal, state or local government agency or authority, may within 30 days of November 20, 2020 submit written comments or objections concerning this bond reduction, and may also request, in writing, that the Division of Mined Land Reclamation hold an Informal Conference concerning this application.
