SUBSTITUTE TRUSTEE'S SALE OF VALUABLE
WISE COUNTY, VIRGINIA
WHEREAS, in execution of a certain Deed of Trust from Christopher E. Collier and Emmit Virgil Collier, dated February 21, 2018, and recorded as Instrument #201800932, in the aforesaid Clerk's Office, granting and conveying to William H. Hayter and John W. Rock, Trustees, certain real estate, in trust;
WHEREAS, by Substitution of Trustee dated July 16, 2020, recorded as Instrument #202004507, in the aforesaid Clerk's Office, Chafin Law Firm, P.C., was substituted as Trustee in the place and stead of the former Trustees;
WHEREAS, the undersigned acting Substitute Trustee will offer for sale at public auction the property located at 7122 Redwine Road, Wise, Virginia, and more particularly described as follows:
All that certain tract or parcel of land, together with improvements situate thereon and appurtenances thereto appertaining, located in the Hurricane Section in Gladeville Magisterial District of Wise County, Virginia, Virginia, more particularly bounded and described as follows, to-wit:
BEGINNING at a 10” Sourwood a Southwest corner to Tract #6; thence with Tract #6 N 85 degrees-35' E, 205.00' to an iron pin a corner to Tract #9; thence leaving Tract #6 and with Tract #9, S 29 degrees-40 E, 285.42' to an iron pin a Southwest corner to Tract #9 and a corner to Tract #10; thence leaving Tract #9 and with Tract #10, S 72 degrees-30' W, 51.00' to an iron pin in the right of way of an existing 20' access road; thence S 72 degrees-30' W, 23.23' to an iron pin in the right of way of said 20' access road, being a corner to Tract #11; thence with Tract #11, S 72 degrees-30' W, 35.23' to a 20” Locust, a corner to Tract #3; thence leaving Tract #11 and with Tract #3, N 64 degrees-38' W, 168.14' to a 4” Sourwood a corner to Tract #2; thence leaving Tract #3 and with Tract #2 N 24 degrees-50' W, 212.77' to the Beginning, containing 1.28 acres, more or less, and shown on map of Adkins Surveyors, dated 8/8/78, a copy of said map being recorded with Instrument No. 201704078, and incorporated herein by reference.
PLACE OF SALE: At bottom of stairwell located in the hall at front door of Circuit Court Clerk's Office, Wise County Courthouse, 206 East Main Street, Wise, Virginia
TIME OF SALE: November 30, 2020, at 11:00 a.m.
TERMS OF SALE: Cash, TEN (10) percent deposit on day of sale with settlement in full within THIRTY (30) days of sale. Title will be conveyed by Substitute Trustee's Deed upon payment of the balance of the bid. Payment of both bid deposit and balance must be made by cash, cashier's check, certified check, or postal money order payable to the undersigned as Substitute Trustee for The First Bank and Trust Company.
EASEMENTS AND RESTRICTIONS: This property will be sold subject to all easements, rights of way and restrictions on said property, if any there be, to the extent that they are binding on said property and on the present owner. The Substitute Trustee RESERVES the right: (i) to waive the deposit requirements; (ii) to extend the period of time within which the Purchaser is to make full settlement; (iii) to withdraw the Property from sale at any time prior to the termination of the bidding; (iv) to keep the bidding open for any length of time; (v) to reject all bids; and (vi) to postpone or continue this sale from time to time, such notices of postponement or setting over shall be in a manner deemed reasonable by the Trustee. Announcements made on day of sale take precedence over all other advertised terms and conditions.
