MILTON BARNES, if living, whereabouts unknown, and if not living, ALL PERSONS CLAIMING BY OR THROUGH MILTON BARNES, deceased, in Lots One (1) and one half of Lot Two (2), adjoining said Lot One (1) in
Block Two (2), on Kohn & Longinia Plat, Big Stone Gap, Virginia, recorded in Deed Book 11, Page 245; and practically all of Lot Number Three (3) and a small portion of Lot Number Two (2) as shown on plat known as the
Kohn & Longinia Plat, BEGINNING at a corner of lots numbered three and four on the East side of Spring Street, thence with a line between said lots three and four,
N 82 degrees 30 minutes East one hundred and thirty feet to a stake; thence North seven degrees 30 minutes West sixty-three feet and forty-two one hundredths feet to a stake; thence South 74 degrees 24 minutes West one hundred and thirty-eight feet to a stake in the east side of Spring Street, thence
with the east side of said street and on a line of same southwardly on a curve to the right four and fifty-eight hundredths feet to the BEGINNING. The land embraces practically all lot number three and a small portion of lot number 2, as shown upon a plat of a part of said Town of Big Stone Gap,
designated as “Kohn and Longinia” Addition to said Town of Big Stone Gap, Virginia, made by Horace E. Fox, engineer, and which plat is here referred to for a further description of the lot piece or parcel of and hereby conveyed, all being located in the Town of Big Stone Gap, in Wise County,
The object of this suit is to partition the real estate, in one of the modes prescribed by law, and particularly so as to allow the plaintiff to acquire the interest outstanding in the real estate described in the style of this suit by purchasing the interest of the defendant in exchange for the fair market value of his/their respective interests.
An Affidavit having been made and signed that the defendant, Milton Barnes, if living, is of unknown whereabouts, and there are or may be unknown persons in interest claiming by or through Milton Barries, it is hereby ORDERED that the defendant, or those claiming by or through him, appear on or before July 20, 2020, and do whatever is necessary to protect his interest in said land.
It is further ORDERED that this Order of Publication be published once a week for four (4) consecutive weeks in the Coalfield Progress, a newspaper of general circulation in Wise County, Virginia.
